Summary

In the context of administrative legal regulation, it is impossible to do without the prompt legislative response to new challenges related to military administrative offenses. Constant updates to administrative offense legislation, particularly amendments to the Code of Ukraine on Administrative Offenses, reflect the realities arising from social and political changes, as well as the lack of clear responsibility for offenses in the military environment prior to 2015. The integration of Chapter 13-B of the Code of Ukraine on Administrative Offenses allowed for the establishment of the grounds for administrative responsibility of military personnel, particularly for the abuse of power, which is relevant in the context of the increasing volume of mobilization of the Armed Forces of Ukraine.

The author analyzes the reasons and conditions that negatively impact the application of the provisions of Art. 172-14 of the Code of Ukraine on Administrative Offenses. These include the lack of a clear definition of the terms “military service person” and “military official”; the correlation of the terms “special period” and “martial law.” Furthermore, the presence of evaluative concepts such as “manifest abuse of power” and “significant harm” does not allow for a clear distinction between an administrative offense and a criminal act.

The issue of sanctions is also important, as fines and detention with confinement to a guardhouse do not always correspond to the consequences of such offenses. It is proposed to supplement the sanctions of Art. 172-14 of the Code of Ukraine on Administrative Offenses with a punishment such as deprivation of the right to hold certain positions. This would enhance control over the actions of military personnel and prevent possible abuses.
